1. Acceptance of Terms

By accessing or using postureguymike.com, the Posture Guy mobile app (iOS and Android), or purchasing any of our programs or digital products, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to update these terms at any time; continued use of the site or app constitutes acceptance of the revised terms.

2. Programs and Digital Products

All programs sold through Posture Guy Mike are digital products delivered via online access through postureguymike.com and the Posture Guy mobile app:

Individual Program Purchases

• Individual Fix It Program purchases are one-time payments granting permanent access to that specific program.
• Your access to individually purchased programs is not affected by any subscription status — you keep access even if you never subscribe to Posture Guy Pro, or if you cancel a Pro subscription.
• Access is provided through your account on postureguymike.com.
• Programs are for personal, non-commercial use only.
• Our 30-day money-back guarantee is described in Section 6 (Payment and Refunds).

Posture Guy Pro Subscription

• Posture Guy Pro is a recurring subscription (monthly or annual) that grants access to all programs in the library for the duration of your active subscription.
• Cancellation: when you cancel your Pro subscription, access to programs provided through the subscription ends at the close of your current billing period. You will not retain access to programs you have not individually purchased.
• Individually purchased programs remain accessible regardless of subscription status.
• Subscription pricing and billing cycles are displayed at checkout and may change with advance notice.

• Not medical advice: all programs are for general fitness and wellness purposes and do not constitute medical advice, diagnosis, or treatment. See Section 3.

3. Mobile App

The Posture Guy mobile app is available on iOS and Android and is subject to these Terms of Service in addition to the terms of the applicable app store (Apple App Store, Google Play Store).

• The mobile app requires an account and an active program purchase or Posture Guy Pro subscription to access full content.
• The AI posture analysis feature uses your device camera. Photos are processed for analysis and are not permanently stored on our servers. See our Privacy Policy for details.
• Push notifications for daily reminders are optional. You can enable or disable them in your app settings at any time.
• We may update the app from time to time. Continued use of the app after an update constitutes acceptance of any changes to these terms.
• We are not responsible for any issues arising from your device, operating system, or internet connection.

4. Medical Disclaimer

• Always consult your physician or a qualified healthcare provider before beginning any new exercise program, especially if you have a pre-existing medical condition, injury, chronic pain, or have had recent surgery.
• Stop immediately and seek medical attention if you experience sharp pain, shooting pain, numbness, tingling, dizziness, or worsening symptoms during any exercise.
• The AI posture score is an educational tool based on visual analysis only. It is not a medical assessment, clinical diagnosis, or substitute for evaluation by a licensed healthcare professional.
• If you have vertigo, are bedridden, have limited mobility, or any condition that affects your ability to exercise safely, consult your doctor before using these programs. Always work within your comfortable range of motion and use modifications as needed.
• Results vary. Individual outcomes depend on many factors including age, health status, severity of postural issues, and consistency of practice.
• Mike Boshnack (Posture Guy Mike) is a certified corrective exercise specialist, not a licensed physician, physical therapist, chiropractor, or medical professional.
• Posture Guy Mike LLC shall not be liable for any injury, harm, or adverse outcome arising from use of our programs, website, or mobile app.

5. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with others or allow others to access your purchased programs.
• One account per person. Creating multiple accounts to circumvent purchase requirements is prohibited.
• You agree to provide accurate, current, and complete information when creating your account.
• Notify us immediately at legal@postureguymike.com if you suspect unauthorized access to your account.

6. Intellectual Property

All content on postureguymike.com, including but not limited to videos, exercise instructions, images, text, logos, and program materials, is owned by or licensed to Posture Guy Mike LLC and is protected by copyright and other intellectual property laws.

• You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.
• You may not screen-record, download, or redistribute our video content.
• Sharing your account access or program content with others is a violation of these terms and may result in account termination.

7. Payment and Refunds

• 30-day money-back guarantee: if you are not satisfied with your purchase, contact us within 30 days of purchase for a full refund. No questions asked.
• After 30 days, all sales are final and no refunds will be issued.
• All payments are processed securely by Stripe. We do not store your payment card information.
• HSA/FSA eligible: our programs may be eligible for Health Savings Account (HSA) or Flexible Spending Account (FSA) reimbursement. Consult your plan administrator for eligibility details.
• Prices are displayed in US dollars and are subject to change without notice.
• To request a refund, contact support or email support@postureguymike.com with your order details.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Posture Guy Mike LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of our services, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these terms or your use of our services shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in California.
